Pennsylvania DUI Law - Gas Chromatography Blood Alcohol Testing


Gas Chromatography is widely used to test blood alcohol content in DUI cases. Knowledge of how these tests are conducted, and how gas chromatography actually works, is critical for defending clients in these types of DUI cases. If a sample of your blood was taken when you were arrested for a DUI, then it will be tested by gas chromatography.

The Commonwealth will rely upon these blood test results to convict you of a DUI, but these tests are not perfect. Many, many errors are made in the gas chromatography process. As a Pennsylvania DUI defense attorney, it's my job to expose these errors and show why these blood test results are not reliable "beyond a reasonable doubt".

In June of 2015 I attended classes taught by the American Chemical Society and received training in Gas Chromatography at the prestigious Axion Labs in Chicago, Illinois. I had the honor of studying with Dr. Harold McNair and Dr. Lee Polite.

Dr. McNair, widely considered to be the "father of chromatography", is the first person to run a gas chromatograph in the United States, and the first person to earn a Ph.D. in chromatography. He founded the Varian equipment gas chromatography division and later Hewlett Packard. He ran the very first gas chromatograph in the United States while at Perdue. He studied under Nobel Laureate Dr. A.J.P. Martin (who was awarded the Nobel Prize for gas chromatography in 1952), Dr. Steve Dal Nogare and Prof. A.I.M. Keulemans. He developed one of the first chromatography short courses over 35 years ago and has been teaching ever since.

Dr. Polite has been teaching chromatography to professionals for more than 27 years and is the National Instructor for the American Chemical Society’s popular “Practical and Applied GC”, “Fundamentals of HPLC” and all hands-on HPLC and GC courses. Dr. Polite has taught courses for FDA, FBI Academy, EPA and every major pharmaceutical, chemical and petroleum company in the United States. He was conferred his Ph.D. in chromatography by Dr. Harold McNair.
