Pennsylvania DUI Law - Tier 1, Tier 2 and Tier 3 Penalties

In Pennsylvania the operation of a motor vehicle upon the highways of the county while your Blood Alcohol Content (BAC) is .08 or higher is driving under the influence. Pennsylvania uses a three tier system to determine the penalties for DUI.

At a Glance - Pennsylvania DUI Tiers and Penalties

  • Tier 1
    BAC between .08 and .099
    5% of Pennsylvania DUI arrests are Tier 1.
    First offense - up to six months of probation, $300 fine, alcohol, highway and safety school.


  • Tier 2
    BAC between .10 and .159%
    10% of Pennsylvania DUI arrests are Tier 2.
    First offense - 12 months driver license suspension. 48 hours to 6 months in prison, $500 to $5,000 fine, attend alcohol, highway and safety school.


  • Tier 3
    BAC over .16%
    85% of Pennsylvania DUI arrests are Tier 3.
    First offense - 12 months driver license suspension. 72 hours to 6 months in prison, $500 to $5,000 fine, attend alcohol, highway and safety school.
